are a number of tips that may help you in your decision:
- Develop a clearly defined strategy and policy with regard to lettings to
licensed telecoms operators
- Prepare a robust standard form of telecommunications lease that protects
the landlord's interests and mitigates the effect of the Telecoms Code
- Be fully conversant with the Code and its impact on future plans for the
property. With buildings earmarked for redevelopment, it is essential to get
advice at the beginning of the project and not wait until such time as the
equipment has to be removed to facilitate the plan
- Where equipment has already been installed, ensure that the installation
complies with the terms and equipment rights contained in the agreement
- Be aware of tenants entering into agreements with mobile operators for
macro or micro cells. In the majority of cases agreements without the landlord's
consent constitute a breach of lease, which could lead to litigation
- Recognise the value of individual sites to operator's networks and set the
rents accordingly
- Be aware of the value of third generation technology and negotiate commercial
rents for new and existing sites subject to UMTS upgrades
- Have due regard to the sitting of telecommunications equipment in terms
of implications for Health and Safety
- Maintain a comprehensive record of telecommunications lettings
