With significant revenues on offer from space that would otherwise earn nothing, our advice would be to pursue the options available with caution. Did you know for example, once equipment has been installed, even after the original agreement has expired and even though you own the property, you might not be able to have the equipment removed without first obtaining a Court Order. This is because the operator's occupancy of that space is protected under the Telecommunications Act 1984. The Telecoms Code, as part of this Act, offers certain licensed operators security of Tenure in a form which is quite separate to that of the landlord and Tenant Act 1954.

The implications of this are that if you want to refurbish or redevelop your property at sometime in the future, then the presence of telephony equipment may prevent you from doing so.
